State Agency & Regulatory Framework
Virginia requires written permission from individual park managers for magnet fishing in state parks — an additional step compared to most states. Outside state parks, VDWR public fishing access areas provide legal access points on major Virginia rivers. Virginia Code § 10.1-2305 protects archaeological sites and objects on state-owned property, including submerged cultural resources in state waters. Virginia has been active in prosecuting unauthorized recovery of artifacts from the James and Potomac Rivers. Found firearms must be reported to local law enforcement; Virginia has specific 'found firearms' procedures under Code of Virginia § 59.1-148.3.
State Park Policy
Virginia State Parks (DCR) requires prior written permission from the individual park manager for magnet fishing within state park boundaries. No system-wide permit exists — you must contact each park directly. DCR's State Parks office: (800) 933-7275.
Waterway Access & Navigability
Virginia's major navigable waterways include the James, Rappahannock, Potomac (northern border), Shenandoah, New, and Roanoke Rivers. VDWR manages numerous public fishing access sites. The Potomac River involves Maryland joint jurisdiction.
