State Agency & Regulatory Framework
Montana's Stream Access Law creates excellent public waterway access for magnet fishing — more rivers and streams are accessible to the public in Montana than in most states. FWP manages 300+ fishing access sites statewide. The Missouri and Yellowstone River corridors have significant archaeological resources. Montana's Antiquities Act (MCA § 22-3-401 et seq.) protects archaeological resources on state land. Found firearms must be reported to local law enforcement.
State Park Policy
Montana State Parks (FWP) has not prohibited magnet fishing. Montana's outdoor recreation culture is open and the Stream Access Law provides strong public waterway access.
Waterway Access & Navigability
Montana's Stream Access Law (MCA § 23-2-301) is one of the strongest in the nation, giving the public the right to use the surface of all rivers and streams with a defined bed and banks regardless of navigability or land ownership. This is broader than the federal navigability doctrine. The only restriction is that you must access the water from a legal public access point and cannot trespass across private land to reach it.

Historical Artifact Reporting
Items 100+ years old recovered from public land in Montana may be protected under the Archaeological Resources Protection Act (federal) and Montana state antiquity law. Contact your State Historic Preservation Office before disturbing or retaining any potentially historical find.
